License terms

1. Provider and scope

The provider is Marvin Hülsmann, MHCreations (imprint: mhcreations.de/legal/thirdparty). Questions about licenses and orders: sales@mhcreations.de.

These terms govern the purchase and use of MControl Pro licenses. The free version of MControl is not affected.

2. What you buy

A license is a one-time purchase, not a subscription. It gives you the non-exclusive, non-transferable right to use the Pro features of MControl on the Macs and by the people described in section 3, including future updates of MControl.

MControl is licensed, not sold. Copyright and all other rights remain with the provider.

3. Who may use which license

Personal license: one natural person, for private, non-commercial use. Using it for a job, a business, self-employed work or for clients is not covered – please buy Team licenses.

Student license: the same rights as the Personal license. You may only buy it if you are enrolled at a university or college when you order and you verified an academic email address on this website. It is granted once per person. It stays valid after you graduate, for private use.

Team license: for businesses and organizations of any size, including freelancers. It covers commercial use. An order for N Macs contains N license keys, one per Mac. The organization decides who gets a key: its employees, members and contractors working for it. Keys may be reassigned (section 4), for example when someone leaves.

Not allowed with any license: passing a key on to people outside the license, publishing or selling keys, and using one key on several Macs at the same time.

4. One key, one Mac

Each license key is active on one Mac at a time. The first Mac that activates a key holds it. To use it elsewhere, choose “Remove from This Mac” in MControl, or – if the Mac is lost – free the key on the restore page with your email address and restore code. A key that was moved through the website can be moved again after 14 days.

To enforce this, MControl sends the license key and an anonymous device ID (a hash, never your raw hardware ID) to the license server when you activate and about every 6 hours while online. Your usage data, summaries and chats never leave your Mac. Offline, Pro keeps working for up to 30 days.

5. Price and payment

The prices shown at checkout apply. Team prices are per Mac and decrease with the size of the order. Payment is handled by Stripe, which acts as the seller (merchant of record) and includes the applicable VAT in the checkout. MControl never sees your card details.

Your license key and restore code are shown right after payment. Keep the restore code: with your email address it brings back all keys of your order.

6. Refunds and revocation

Statutory rights, including consumer withdrawal rights, remain unaffected.

If a payment is refunded or disputed, the affected keys stop working at their next check-in. For a partial refund of a Team order, the keys for the refunded Macs (the highest numbers first) are revoked.

We may revoke keys that are used against these terms, for example a Personal license used commercially or a key shared publicly. We will tell you first when possible.

7. Availability and changes

The license server should be available at all times, but we cannot promise uninterrupted service. If it is unreachable, an activated Mac keeps Pro for up to 30 days.

We may improve MControl and change its features. Pro features that were part of the offer when you bought will not be removed without an equivalent replacement.

8. Liability

We are liable without limit for intent, gross negligence, injury to life, body or health, and under the Product Liability Act. For slight negligence we are liable only for the breach of essential obligations (obligations whose fulfilment makes the contract possible and on which you can rely), and limited to the typical, foreseeable damage. Otherwise liability is excluded.

MControl gives suggestions about how you spend your time. It is not medical, legal or professional advice.

9. Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, mandatory consumer protection of their country of residence remains unaffected.

If a provision is invalid, the rest stays in force. We may update these terms for future purchases; the terms at the time of your purchase apply to it.
